JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutors for the State.
The petitioner apprehends his arrest in connection with Mehsi P.S.Case No. 106 of 2013 registered for the offence punishable under Section 393 of the Indian Penal Code.
Taking into consideration the allegation levelled against the petitioner and this aspect of the matter that the petitioner is named in the FIR with specific allegation of committing loot and further, that the petitioner carries criminal antecedent of similar nature, I am not inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Mehsi P.S.Cse No. 106/2013, G.R. No. 3163/2013 pending in the Court of learned Judicial Magistrate, 1st Class, Sadar, Motihari, stands rejected.
However, if the petitioner surrenders before the concerned court within four weeks from the date of receipt/production of a copy of this order and seeks regular bail, the prayer for regular bail of the
Patna High Court Cr.Misc. No.4163 of 2015 (2) dt.30-01-2015 2/2 petitioner shall be considered on its own merit without being prejudiced by this rejection order.
