2. The petitioner apprehends his arrest in connection with Bikram P.S. Case No. 375 of 2023 registered under Sections 365, 363 and 376 of the Indian Penal Code and Section 4 of the POCSO Act lodged on 01.09.2023 by the informant, Anil Ram.
3. As per the prosecution story, the informant alleged that when the victim girl has gone to attend the nature's call, the petitioner committed wrong with her. Accordingly, the FIR.
4. Mr. Ansul, learned counsel for the petitioner submits that the informant is a litigant and has earlier a week
Patna High Court CR. MISC. No.16549 of 2024(3) dt.24-04-2024 2/2 ago also lodged a case against other accused person relating to molestation of the girl. He further submits that actually, he is misusing the privilege granted to under the different Acts.
5. Mr. Jitendra Kumar Singh, learned APP for the State, on the other hand, submits that the earlier case cannot be equated with the present case where there is an allegation of committing wrong with the victim girl, who is a minor. Further submission is that the petitioner is an aged person and is not a teenager.
6. Taking into account the aforesaid facts, the petitioner is well advised to seek bail.
