JUSTICE AMARESH KUMAR LAL ORAL ORDER 03-02-2015 Heard the learned counsel for the petitioners and the learned counsel for the State.

The petitioners apprehend their arrest in Chakia P.S. Case No. 207/2011registered for the offence punishable under Sections 304B, 201/34 of the Indian Penal Code. The allegation is that the petitioner no.2 demanded a shebuffalo as dowry which was refused by the deceased Anita Devi. Thereafter, at the instance of petitioner no.2, other accused tied her hands and legs and after poring kerosene oil, the accused Ramesh Ram set fire which resulted into the death of the deceased. It appears that there is specific allegation of overt act against the petitioner no.2 and at her instance, other accused acted accordingly and caused the death of the deceased. Considering the facts and circumstances of the case, in my opinion, the petitioners do not deserve anticipatory bail. Their prayer is rejected.
