The petitioner seeks regular bail in connection with Biharsharif Rail PS case no. 06 of 2015 registered for the offences punishable under Sections 341, 323, 324, 307, 379 of Indian Penal Code.
The allegation of the prosecution is that while the informant was traveling in a train along with his wife and two children, the petitioner is said to have snatched the earrings from the ear of the wife of the informant whereafter he started fleeing away. It is further stated that while the petitioner was fleeing away, the informant along with others and one motorcycle borne person tried to apprehend the petitioner and finally, when the petitioner was apprehended, he gave a knife flow on the left hand
Patna High Court Cr.Misc. No.29254 of 2017 (2) dt.01-07-2017 2/2 of the motorcycle borne person causing injury to him. The police is said to have arrived at the spot and apprehended the petitioner. Learned counsel for the petitioner submits that petitioner is in custody since 02.08.2015 having clean antecedent. Having regard to the facts and circumstances of the case and more particularly, the fact that the petitioner has been incarcerated for a long time, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge-IX, Patna in connection with Biharsharif Rail PS case no. 06 of 2015.
