1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Katihar Complaint Case no. 1104 of 2016 registered under sections 498A, 494, 323, 504 and 120B of the Indian Penal Code.

3. As per the allegations in the complaint, the complainant who was married to the petitioner herein was tortured for demand of dowry. She was assaulted and forced out of the house.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The

Patna High Court CR. MISC. No.16711 of 2024(2) dt.14-03-2024 2/2 allegations of the petitioner of having entered into a second marriage or the allegations of cruelty are all false and concocted. The petitioner is in custody since 8.7.2023 and undertakes to cooperate in the case. He has no criminal antecedent.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and taking into consideration the allegations in the complaint, the petitioner having remained in custody for 8 months since 8.7.2023 and not having any criminal antecedent, the petitioner is directed to be enlarged on bail in connection with Katihar Complaint Case no. 1104 of 2016, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate- V, Katihar.
