JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2019 This is an application for grant of anticipatory bail in connection with Kako P.S. Case No. 323 of 2018, disclosing offences under Sections 147, 148, 149, 323, 337, 338, 307, 353, 379, 511, 333, 332, 186, 189 and 504 of the Indian Penal code. Prosecution case as per the FIR is that there was election for constitution of School Education Committee, Satanpur and informant, Officer-in-charge, Kako Police Station, was posted for maintain law and order and during meeting two groups had quarreled. Informant tried to pacify them, but they assaulted the police personnel also and try to snatch fire arms, thereafter, the police have fired two rounds. No.15455 of 2019(3) dt.02-05-2019 2/2 petitioner is that nothing specific has been attributed against the petitioner and another co-accused persons have been granted privilege of anticipatory bail vide order dated 07.03.2019 passed in Cr. Misc. No. 13418 of 2019 and vide order dated 12.04.2019 passed in Cr. Misc. No. 20003 of 2019.

Heard learned A.P.P. also, who has opposed the prayer of anticipatory bail to the petitioner.

Having heard both parties.

In view of the facts and circumstances as stated above, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/-( Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class Jehanabad in connection with Kako P.S. Case No. 323 of 2018, subject to that condition that laid down under Section 438(2) of the Code of Criminal Procedure.
