01-02-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.
Petitioner, in the present case, is seeking regular bail in connection with Gurua P.S. Case No. 18/2017 registered for the offence punishable under Sections 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that the F.I.R. is against unknown, however petitioner has been remanded in this case when he was arrested in connection with another case.
An extra judicial confessional statement has been extracted from him. He is in custody since 08.06.2017, but till date, no T.I. parade has been conducted. It is submitted that nothing
Patna High Court Cr.Misc. No.4452 of 2018 (2) dt.01-02-2018 incriminating has been recovered from the possession of this petitioner. As regards criminal history, he submits that the police have falsely implicated him in two other cases in which he is on bail.
Learned counsel for the State is present. Save and except the confessional statement of this petitioner there is no other material to connect him.
Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Sherghati, Gaya, in connection with Gurua P.S. Case No. 18/2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
