JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 20-04-2022 The petitioner seeks pre-arrest bail in connection with Motihari Town P.S. Case No.805 of 2019 registered under Sections 420 and 406 read with 34 of the Indian Penal Code. Vide order dated 27.05.2021, notices were issued to the informant of the case both by ordinary process as well as registered cover with A/D.

The registry has reported that the notice sent though registered cover has been personally received by the informant.

In spite of the service of notice, the informant has neither appeared in person nor he is being represented through any counsel.

Considering the nature of allegation made in the

Patna High Court CR. MISC. No.23477 of 2021(4) dt.20-04-2022 2/2 first information report as also the reluctance of the informant to appear before the Court in spite of receipt of notice, the provisional pre-arrest bail granted to the petitioner vide order dated 27.05.2021 is, hereby, confirmed.
