2. In the present case, the petitioner is apprehending her arrest in connection with Naugachia Mahila P.S. Case No. 35 of 2025, registered for the offences punishable under Sections 498A, 341, 323, 504 and 506 read with Section 34 of the Indian Penal Code and Sections 3 and 4 of D.P. Act.

As per prosecution case, the informant has been married with the son of the petitioner in the year 2018 and allegation against the petitioner and other co-accused persons is that they have been demanding rupees five lakhs in dowry. Further allegation is that the petitioner and other co-accused persons have been physically and mentally torturing the

4. Learned counsel for the petitioner submits that the petitioner is innocent and she has falsely been implicated in this case. The allegation of demand of rupees five lakhs in dowry and consequent torturing related to non-fulfillment of this demand is completely false and concocted. The allegations are not believable as marriage was solemnized on 16.12.2018 and till 03.06.2025, no complaint has been made. Learned counsel further submits that it appears that the relationship between husband and wife deteriorated over time and getting disturbed by the acts of her son and daughter-in-law, the petitioner separated herself from them in the month of December, 2023 and since then, she has no concern with the affairs of her son and daughter-in-law. Petitioner is a widow lady and she has got no criminal antecedent.

5. Learned APP opposes the submissions made on behalf of the petitioner and submits that petitioner is mother-inlaw and there is allegation of demand of dowry and consequent torture against the petitioner and other co-accused persons.

6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the nature of relationship of the petitioner with the informant and

No.14808 of 2026(2) dt.01-04-2026 3/3 also considering the possibility of false accusation, let the petitioner above-named, in the event of her arrest or surrender before the Court concerned within a period of eight weeks from today, be released on bail, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Naugachia, Bhagalpur, in connection with Naugachia Mahila P.S. Case No. 35 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S. and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the Court below, if so required by the learned trial Court.
