The petitioner seeks bail in Ujiarpur P.S. Case No. 22 of 2017, instituted for the offence under Section(s) 394 and 412 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. No Test Identification Parade has been held. The name of petitioner has come in the confessional statement of co-accused Raman Kumar who was apprehended in Samastipur Rail P.S. Case No. 53 of 2018. Counsel for the petitioner further submits that co-accused Dhiraj Singh @ Dukkha Singh @ Dukhan Singh with similar allegation has already been granted bail by this Court vide order dated

Patna High Court CR. MISC. No.19615 of 2019(2) dt.01-04-2019 2/2 9.10.2018 passed in Cr. Misc. 55141 of 2018.

Petitioner is in custody since 11.5.2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Dalsinghsarai, Samastipur, in connection with Ujiarpur P.S. Case No. 22 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
