JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-07-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 304B, 506/34 of the Indian Penal Code.
Earlier the prayer for bail of the petitioner was rejected by this court giving liberty to petitioner to renew his prayer for bail if his trial is not concluded within seven months from the date of receipt/production of copy of the said order. The impugned order dated 17.06.2017 goes to show that order dated 25.10.2016 passed in Cr. Misc. No. 31528 of 2016 was received in the trial court on 15.11.2016 and thereafter charge was framed on 16.12.2016 but in spite of issuance of summons, bailable warrants
Patna High Court Cr.Misc. No.31948 of 2017 (2) dt.12-07-2017 2/2 and non-bailable warrants, up till now, only two prosecution witnesses could be examined and therefore, the aforesaid fact goes to show that there is no possibility of conclusion of trial of the petitioner in near future.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-1st, Munger in connection with Sessions Trial No. 223 of 2016 arising out of Muffasil P.S. Case No. 247 of 2015.
