JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the State. Petitioner is accused in Baheri P.S. Case No. 15 of 1989 registered for the offences punishable under Sections 144/379 of the Indian Penal Code.

It appears from the impugned order that the petitioner was earlier enlarged on bail but his bail bond was cancelled on 01.07.2015 due to lack of Pairvi in the case. The petitioner was arrested on 10.04.2017. Petitioner is an old man aged about 90 years as appears from the order of the court below. Having regard to the fact that earlier petitioner was enlarged on bail and due to lack of Pairvi his bail bond was cancelled and the fact that learned Sessions Judge in his order has noted the age of the petitioner as 90 years, I am inclined to enlarge the petitioner, above named, on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.27279 of 2017 (2) dt.01-07-2017 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Darbhanga in connection with Baheri P.S. Case No. 15 of 1989, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and will not, in any manner, influence the witnesses.
