JUSTICE ARUN KUMAR ORAL ORDER 14-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Barhara PS Case No. 64 of 2017 registered under Sections 302 and 379/34 of the IPC. It is submitted that the petitioner and the deceased both are co-villagers, only allegation is that he had come to the informant's house and had taken son of the informant with his tempo, after some hours the dead body was found and merely on the basis of suspicion the petitioner has been made accused in this case.

Whereas learned Counsel for the State submits that only within three hours of taking away the informant's son his dead body was found and the petitioner is accused in two murder cases, bail of another co-accused Bhutali Singh was rejected with observation. Having considered the said facts and circumstances the prayer for bail of the petitioner is rejected with a direction to the trial court to expedite the trial and preferably conclude the same within a year after framing of the charge. If the trial does not conclude within the aforesaid period the petitioner may renew his prayer for bail. Snkumar/- (Arun Kumar, J.)
