JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 17-05-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Hajipur Town P.S. Case No. 363 of 2022, registered for the offences punishable under Sections 467, 468, 471, 120(B) of the Indian Penal Code and Section 30(a), 32(ii), 38(i), 41(i) of Bihar Prohibition and Excise Act, 2018.

As per allegation, 5490 liters of liquor was recovered from a truck.

The learned counsel for the petitioner has submitted that except confessional statement of co-accused Pankaj Rai, there is nothing against the petitioner. He was not arrested at the spot and is a person of clean antecedent. He is under custody

Patna High Court CR. MISC. No.13623 of 2023(2) dt.17-05-2023 2/2 since 18.01.2023.

On the other hand, the learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No. 1cum-Additional District and Sessions Judge, Vaishali at Hajipurin connection with Hajipur Town P.S. Case No. 363 of 2022, subject to the following conditions:- (i)Before accepting the bail bond of the petitioner, the learned court below shall verify his criminal antecedent and if it is found that the petitioner is involved in any other case except the present one, the learned court below shall not accept his bail bond.
