JUSTICE SANJAY PRIYA ORAL ORDER 25-07-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in connection with Majorganj P.S. Case No. 256 of 2015, G.R. No. 3608 of 2015, Distt. Sitamarhi instituted for the offence under Section 363, 364 and 302 of the Indian Penal Code.
As per written report, the son of the informant has gone to purchase Chowmin from Santoshi Mata Temple but he did not return. The informant searched his son at his relative's house but he could not trace him. Informant has suspected that some unknown persons have kidnapped his son for illegal purpose. From the case diary, it appears from the statement of one Priyanka Kumari Gupta, that a mobile having SIM no. 8804825764, which was in her name, has been snatched by the son of the informant. It
Patna High Court Cr.Misc. No.30344 of 2017 (3) dt.25-07-2017 2/3 has further been submitted that Priyanka Kumari Gupta is on inimical term with the son of the informant and she has not filed any case for snatching the same. The name of the petitioner has been disclosed in the confessional statements of co-accused Sudhir Kumar and Bablu Singh.
In such circumstances, prayer for anticipatory bail is allowed and it is ordered that the petitioner named above in the event of his arrest or surrender in the court below within six weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Majorganj P.S. Case No. 256 of 2015, G.R. No. 3608 of 2015 to the satisfaction of learned A.C.J.M.-1st, Sitamarhi subject to condition as laid down under Section 438(2) of the Cr.P.C. with further conditions (i) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (ii) petitioner shall co-operate in the trial and shall be present on each and every date fixed by the court and absence on two consecutive dates without proper and reasonable reason, will automatically cancel bail bond of the petitioners and (iii) if petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation
