The petitioner is in custody in connection with Sugauli P.S. Case No. 369 of 2018 for the offence under Section 379 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that for the same occurrence two cases namely Sugauli P.S. Case No. 409 of 2018 and Sugauli P.S. Case No. 369 of 2018 were registered. He further submits that petitioner was granted bail in Sugauli P.S. Case No. 409 of 2018 which was registered under Section 414 of the Indian Penal Code. He submits that petitioner is in custody since 31.10.2018 Considering the fact that petitioner has remained in custody for more than four months, let the petitioner above
