1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Telhara P.S. Case no.165 of 2024 registered under sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

3. As per the prosecution case, the petitioner was appointed as a Niyojit Panchayat Teacher. On getting his teachers training mark-sheet and certificate sent for verification, it is stated that the Office of the Director, State Council of Education Research and Training, Guwahati, Assam replied back that the certificate of the petitioner was forged. 4. Learned counsel for the petitioner submits that the petitioner has not deposited any forged certificate and has been falsely implicated in the case. In any case of the matter, now he has been dismissed from service. It is further stated that the evidence is primarily documentary in nature which is already in possession of the investigating authorities. The petitioner has no criminal antecedent and undertakes to cooperate in the case.

5. The application for anticipatory bail is opposed by learned counsel for the Vigilance Investigation Bureau. Referring to the counter affidavit filed on behalf of the Vigilance Investigation Bureau, it is submitted that on getting the teachers training mark-sheet and certificate produced by the petitioner and on the basis of which he obtained his appointment verified, the same was found to be forged and fake. It is submitted that similar bail application of others has also been rejected on earlier occasion. This application may also be rejected.

6. Having heard learned counsel for the parties and taking into consideration the nature of allegation against the petitioner in the F.I.R. according to which the teachers training certificate on the basis of which the petitioner obtained his

No.14465 of 2025(2) dt.28-03-2025 3/3 appointment as a teacher, on verification having been found to fake, the petitioner in the meantime having been dismissed from service and especially the petitioner not having any criminal antecedent, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Telhara P.S. Case no.165 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Ist, Hilsa, Nalanda.
