JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-07-2017 The petitioner seeks regular bail in connection with G.R.P. Jamalpur P.S. Case No. 42 of 2016, registered for offences punishable under Sections 25(1)(a-b) (1-a,a) (1-b)e. 26/35 of the Arms Act.

Allegation against the petitioner is of recovery of large quantity of semi manufactured arms.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and further shows that seizure list itself shows that the seized articles were semi manufactured pistol and as such no case under the above mentioned sections of Arms Act is made out against the petitioner. Further petitioner has been in judicial custody since 18.08.2016. Heard learned A.P.P. also.

Having heard both sides, considering the facts and

Patna High Court Cr.Misc. No.31677 of 2017 (2) dt.13-07-2017 2/2 circumstances of the case and the nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.

However, the trial court is directed to expedite the trial and try to conclude it within a period of six months. At the same time, S.P. Railway, Jamalpur is also directed to ensure the Production of witnesses in the court on the date fixed so that the trial can be concluded within the prescribed period.
