JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act of the Indian Penal Code.

From a tractor, 46 bags of wheat weighing 22 quintals and 18 bags of rice weighing 19 quintals were seized when it was found that the petitioner purchased the said grains from fair price shop of Sunita Devi and the same was carried to the shop of Amit Kumar Chaudhary.

It is submitted by learned counsel for the petitioner that the petitioner is not a PDS dealer and only on suspicion, the accusation has been levelled. No shortage has been found in the fair price shop of Sunita Devi. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named

Case No. 154 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
