The present writ petition has been filed for seeking direction to remove the restriction on the petitioner's land from sale.

Counsel for the petitioner submits that he has filed representation on 04.04.2022 before respondent No.2 for granting permission for alienation of the land. Counsel fairly submits that the land in question is the subject matter of the Title Suit No. 347 of 1940 which was decided ex-parte in favour of the grandfather of the petitioner and there is no further litigation on this land.

Patna High Court CWJC No.3158 of 2023(2) dt.19-07-2023 2/2 Counsel for the State submits that he has no objection if matter shall be referred before the Collector, Siwan and liberty may be given to the petitioner for hearing. In this view of the matter, petitioner is directed to represent before the Collector, Siwan for his grievances which he has raised in the writ petition, within 4 weeks along with this order and the Collector, Siwan shall pass an speaking and reasoned order upon granting opportunity to the petitioner of hearing within 8 weeks from the date of filing the representation.

It is made clear that this Court has not passed any order on the merit of the case.

With this direction, the present writ application is hereby disposed of.
