Petitioner apprehends his arrest in connection with Katihar (Town) P. S. case no. 82/2013 registered under section 307 and other allied sections of the IPC.

Petitioner is named in the first information report but no specific overt-act has been attributed against him. Similarly, impugned order of learned Sessions Judge also does not reflect any specific role of the petitioner except that he was leading the mob at the time of alleged occurrence but no such allegation has been made in the first information report. Moreover, learned Sessions Judge has already granted privilege of anticipatory bail to several co-accused persons. Therefore, taking into consideration the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to

Patna High Court Cr.Misc. No.3470 of 2015 (2) dt.27-01-2015 the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in Katihar (Town) P. S. case no. 82/2013 subject to condition as laid down under section 438(2) of the Cr.P.C.
