JUSTICE VIKASH JAIN ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 01-04-2015 This appeal is preferred by two persons, namely Harendra Kumar Singh, son of Raghunandan Singh and Sri Ram Singh, son of Deoki Singh. They were convicted by the Court of Additional Sessions Judge IX, Patna in Sessions Trial No.246 of 1985 through judgment dated 10.06.1992 for the offences punishable under Section 302 of the Indian Penal Code and were sentenced to undergo imprisonment for life.
While admitting the appeal, this Court directed for release of the appellants on bail through order dated 21.07.1992. Recently, the matter was listed for hearing on 09.01.2015. A Division Bench of this Court, which heard the matter found that the records of the trial court were not available
Patna High Court CR. APP (DB) No.246 of 1992 (5) dt.01-04-2015 2/2 and called for a report from the Senior Superintendent of Police, Patna as to whether the appellants are alive. In response to that the Senior Superintendent of Police, Patna addressed letter dated 27.03.2015 stating that the enquiry about the appellants revealed that both of them died and the statement of the Village Mukhiya in this behalf was also enclosed.
Learned Additional Public Prosecutor has also perused the report and did not state anything contrary to that. Therefore, the appeal is dismissed as abated. (L. Narasimha Reddy, CJ) (Vikash Jain, J) Sunil/- U T
