2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 392 of the Indian Penal Code.

3. It is a case of robbery of Rs. 25,000/- cash, mobile and motorcycle of the informant by four unknown miscreants.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner is not named in the FIR. His name was transpired on the basis of re-statement of the informant who raised suspicion against the petitioner and other three miscreants. During investigation, a motorcycle as well as a mobile were seized by

Patna High Court CR. MISC. No.21042 of 2024(3) dt.26-04-2024 2/2 He has got no criminal antecedent and he is languishing in judicial custody since 23.10.2023. Other co-accused Mahesh Kumar has already been enlarged on bail by this Court vide order dt. 8.2.2024 passed in Cr. Misc. No. 4440 of 2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail after framing of charge, if not framed in connection with Rajnagar P.S. Case No. 271 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, District- Madhubani.
