The petitioner seeks bail in connection with G.O. Case No. 2 of 2020 all Bahadurpur P.S. Case No. 657 of 2019, registered under Sections 30(a) and 30(c) of the Bihar Prohibition and Excise (Amendment) Act, 2016. The accusation is that in course of patrolling duty the informant, along with other police personnel, saw some persons unloading materials from tempo. On seeing the police party, all started to flee away, but, on chase, Lalu Mistri, Ashok Kumar Yadav (petitioner), Shiv Shankar Paswan, Rahul Yadav and Rakesh Nunia were apprehended. They also disclosed the name of two persons Rahul Yadav and Rakesh Yadav, who succeeded to flee away. On search of tempo 60 liters Nepali Saufi wine recovered.
Patna High Court CR. MISC. No.13879 of 2020(2) dt.03-03-2020 2/2 Mr. Sanjeev Kumar Jha, the learned counsel appearing on behalf of the petitioner submits, at the Bar, that this petitioner has no concerned with the seized tempo. Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with G.O. Case No. 2 of 2020 all Bahadurpur P.S. Case No. 657 of 2019 to the satisfaction of the Additional Sessions Judge III-cumSpecial Judge, Excise Act, Darbhanga. (Rajendra Kumar Mishra, J) Shamshad/- U T
