====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 05-03-2020 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek bail in a case for the offence registered under Sections 302/34 of the IPC.

The prosecution story, in brief, is that on 04.05.2018 at 9.00 A.M. the informant got information from the Sasural of Vimlesh Manjhi that he is suffering from diarrhoea and his condition is very serious. Upon which, the informant and his family members reached there and saw the dead body of Vimlesh Manjhi. His mother-in-law and wife were present there. Father-in-law and brother-in-law were absconding. It is alleged

Patna High Court CR. MISC. No.12693 of 2020(2) dt.05-03-2020 2/3 by him that murder of Vimlesh Manjhi has been done by pressing his neck by his Sasural people as Yogendra Manjhi, Suraj Manjhi, wife Soni Devi and mother-in-law Shivanti Devi. It has been submitted by learned counsel for the petitioners that the petitioners are in custody since 06.12.2019. The petitioners have falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioners. The petitioners are the wife, mother-in-law and brother-in-law of the deceased. Neither there is eye witness to the alleged occurrence nor there is circumstantial evidence to suggest the implication of the petitioner in the present case. Other co-accused has been granted bail by another Co-ordinate Bench of this Court vide Cr. Misc. No. 19762 of 2019 under order dated 03.06.2019 annexed as Annexure-2 to the present application.

On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned
