The petitioner seeks bail in Nabinagar P.S. case No. 174 of 2013 under Section 302 and other Sections of the Indian Penal Code, under Sections 3, 4, 5 of the Explosive Substance Act and under different Sections of U. A. P. Act. The informant named the petitioner at serial No.9 of the fard bayan and alleged that villagers disclosed the name of accused persons, who exploded bomb causing death of police personnel.

The learned counsel for the petitioner submits that the informant did not disclose the name of villagers, who disclosed the name of petitioner and other accused persons. During the course of investigation, none of the villagers disclosed name of the

Patna High Court Cr.Misc. No.21374 of 2017 (4) dt.03-07-2017 2/2 petitioner. Similarly situated accused Dharmendra Yadav and Sitaram Bhuiyan have been granted bail vide order passed in Cr. Misc. No. 18653 of 2015. Other similarly situated accused, namely, Gani Ansari, Yugesh Yadav, Sukesh Jee @ Surendra Yadav and Lallu Singh have also been granted bail vide orders annexed as Annexure-2 series of this bail petition. The learned Additional Public Prosecutor did not dispute the facts.

Considering the facts that name of the petitioner is said to have been disclosed by the villagers but neither the informant nor the witnesses disclosed the name of petitioner and other similarly situated accused have already been granted bail, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Nabinagar P.S. Case No. 174 of 2013.
