JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner as well as learned APP for the State.

For an occurrence allegedly committed on 02.08.2016, written report was filed on 07.08.2016 by the victim, Nageshwar Mahto alleging, inter alia, that during course of proceeding ahead towards his house over motorcycle, he was intercepted by Pramod Mistry son of Prasadi Mistry who inquired about his destination. Furthermore, proceeding ahead when he reached at Rampur Mor, motorcycle borne criminals whom he identified, out of whom, Shambhu Mistry fired at him causing injury over his right thigh followed by Ranjay Mahto as well as Sikandra Mahto. It has also been disclosed that the aforesaid eventualities have been conspired by Bano Mistry (petitioner) as well as Chandan Mistry. According to written report itself,

Patna High Court Cr.Misc. No.26191 of 2017 (3) dt.01-07-2017 petitioner at the relevant time was under custody. From the order impugned, it is evident that no concrete material has been collected against the petitioner.

Consequent thereupon, petitioner, Bano Mistry is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of ACJM, 2nd Jamui in connection with Sikandra PS Case No. 111 of 2016.
