2. The petitioner is seeking regular bail in connection with Mushari P.S. Case No. 268 of 2024 for the offences punishable under Sections 317(5), 55 of the BNS and Sections (25-1 AA), 26, 35 of the Arms Act.

3. Allegedly, one automatic pistol with 8 live cartridges was recovered from waist of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Due to political rivalry, he has been made an accused in a number of cases. As a matter of fact, nothing was recovered from the possession of the petitioner.

5. On the other hand, the learned APP for the State has opposed the prayer for bail and submitted that the petitioner is a

Patna High Court CR. MISC. No.16535 of 2025(3) dt.12-05-2025 2/2 person of strong criminal background, with a number of cases against him, including cases of murder, attempt to murder, and also under the Arms Act. A country made pistol and 8 live cartridges were recovered from his possession.

6. Considering the above-mentioned facts and circumstances as well as the gravity of the allegation, I do not think it to be a fit case for bail, which is hereby rejected. (Nawneet Kumar Pandey, J) Nirmal/- U T
