JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323 and 504/34 of the Indian Penal Code, Section 2(V), 3, 5 and 18 of the Bihar State Mahua Flower Rules, 2006 and Section 47A of the Excise Act. It is alleged that a truck loaded with Mahua flower belonging to the petitioner was intercepted and handed over to the police.

It is submitted by learned counsel for the petitioner that actually no recovery has been made from the petitioner and since the petitioner was on litigating terms with the informant, he has been roped in the present case. The petitioner is in no way connected either with the mahua flower or with the alleged truck. A statement to that effect has been made in para 9 of the petition.

No.3422 of 2015 (2) dt.27-01-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Gaya in connection with Tekari P.S. Case No. 44 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
