JUSTICE BIRENDRA KUMAR ORAL ORDER 03-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.
The F.I.R. was lodged on recovery of the dead body of the son of the informant. The petitioner and others are suspected to be the murderers.
Learned counsel for the petitioner submits that the case diary would reveal that only material against the petitioner is confessional statement. Some other co-accused having similar allegation have already been allowed bail by different coordinate Benches of this Court, orders already annexed
Patna High Court Cr.Misc. No.18465 of 2017 (4) dt.03-07-2017 2/2 with the bail petition.
Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XV, Gopalganj/Successor Court, in connection with Kateya P.S. Case No.221 of 2016, T.R. No.1370 of 2017, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
