JUSTICE BIRENDRA KUMAR ORAL ORDER 03-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offence punishable under Section 384 of the Indian Penal Code. From the referred mobile ransom was demanded by threatening the informant for causing his death in the event of non-payment of ransom. The SIM card from which demand was made was used in the mobile phone of this petitioner though the SIM was not of the petitioner.
Learned counsel for the petitioner submits that the petitioner is in custody since 14.11.2016. Considering the nature of allegation and the period already undergone by the petitioner, let petitioner, above
Patna High Court Cr.Misc. No.22123 of 2017 (3) dt.03-07-2017 2/2 named, be enlarged on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Birpur at Supaul/Successor Court, in connection with Pratapganj P.S. Case No.70 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
