JUSTICE BIRENDRA KUMAR ORAL ORDER 03-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 302/34 of the Indian Penal Code.

Petitioner is brother of the husband of the deceased. Marriage was solemnized ten years back. Allegation is that death for dowry was committed by the in-laws for nonfulfilment of the dowry demand. Submission of learned counsel for the petitioner is that the presumption of dowry death is not against the petitioner. There is no eyewitness of the occurrence and only on suspicion F.I.R. has been lodged.

No.24070 of 2017 (3) dt.03-07-2017 2/2 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII, Madhubani/Successor Court, in connection with Ladania P.S. Case No.38 of 2014, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
