JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 01-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Informant, victim a girl, aged about 16 years, was enticed away by the petitioner along with Balbir Kumar @ Amitesh Kumar to the house of one Satyendra Sao, where Balbir Kumar @ Amitesh Kumar committed rape.
Learned counsel for the petitioner submits that though in the written report, there happens to be an allegation against the petitioner but during course of statement under Section 164 Cr.P.C., petitioner has not been named. He has also submitted that the case has been compromised.
Learned Additional Public Prosecutor opposed the prayer.
The effect of compromise will be seen by the learned
Patna High Court Cr.Misc. No.12431 of 2016 (2) dt.01-04-2016 2/2 lower court at the time of consideration of bail at the end of the petitioner and with the aforesaid observation, instant petition is, hereby, disposed of.
