JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 03-07-2017 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in Sitamarhi P.S. Case No. 121 of 2017 registered under Sections 406, 420, 467, 468, 471 and 34 of the Indian Penal Code and Sections 3, 4 and 5 of the Prize Chits and Money Circulation Scheme (Banning) Act, 1978. The petitioners are said to have running a chit fund company in the name of Amulya Sanchay Producer Company Limited situated at Nahar Chowk, Sitamarhi without permission of the District Magistrate.

It is submitted by learned counsel for the petitioners

Patna High Court Cr.Misc. No.28807 of 2017 (2) dt.03-07-2017 2/2 that the petitioners are employees of the said company and the company is registered under the Companies Act. With regard to the running of the said company, information was given to the District Magistrate, Sitamarhi vide Annexure-2. The petitioners have been languishing in custody since 01.03.2017. Co-accused Dinesh Singh, who is the Branch Manager of the said company, has been enlarged on bail by a co-ordinate Bench of this court vide order dated 28.06.2017 passed in Cr. Misc. No. 28299 of 2017. Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 121 of 2017.
