Petitioners seek bail in a case registered for the offences punishable under Sections 363/365 of the Indian Penal Code.

The petitioners and other named persons are under suspicion to have committed murder of the husband of the informant due to land dispute.

Submission is that in fact the victim had died a natural death. Initially,U.D.case was registered on recovery of dead body. Witnesses have stated before the police that in fact the victim had fallen while fetching water and he had gone for treatment to the Baidya Jee and thereafter

Patna High Court Cr.Misc. No.10672 of 2018 (3) dt.09-04-2018 he died. Further submission is that other named co-accused have already been allowed anticipatory bail by a Coordinate Bench of this Court vide Annexure-5.

Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kako Police Station Case No.133 of 2017, subject to the condition that the petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
