The petitioner seeks bail in Murliganj P.S. case No. 76 of 2015 under Section 392 of the Indian Penal Code. The learned counsel for the petitioner submits that petitioner is not named in the FIR. The petitioner has not been put in T. I. parade. Nothing has been recovered from the possession of the petitioner. Name of the petitioner figured in the case in the confessional statement of co-accused Akram Ahmad Khan and stolen motor cycle was recovered from the possession of Md. Shakeel @ Lalwa. Save and except confession of co-accused, there is no material against the petitioner and the petitioner is in jail since 08.03.2017.
Considering the facts aforesaid and the nature of
Patna High Court Cr.Misc. No.21085 of 2017 (4) dt.03-07-2017 2/2 allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura in Murliganj P.S.
