====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 09-02-2024 Pursuant to order dated 22.12.2023 calling for show cause, explanation dated 11.01.2014 has been received from the learned trial court. The learned Presiding Officer has submitted that due to serious condition of his daughter he went on earned leave during relevant period and for this reason the delay occurred in conclusion of the trial. It has also been informed vide letter dated 27.01.2024 by the learned Presiding Officer that the judgment was delivered on 18.01.2024 and order of sentence was passed on 27.01.2024. The learned Presiding Officer has tendered his unqualified apology for noncompliance of order this Court.

2. Since the matter has been disposed by learned trial

Patna High Court CR. APP (SJ) No.1037 of 2023(8) dt.09-02-2024 2/2 court, explanation of the learned Presiding Officer is accepted with warning that the officer concerned will remain careful in future and would show promptness in compliance of orders of this Court.

3. In the light of the above facts as the appeal has become infructuous, learned counsel for the appellant seeks permission to withdraw the present appeal.

4. Permission is accorded.

5. Accordingly, the present appeal is dismissed as withdrawn.
