JUSTICE ASHUTOSH KUMAR ORAL ORDER 27-03-2019 The petitioner seeks bail in anticipation of his arrest in connection with Khodawandpur P.S. Case No. 121 of 2018, dated 17.06.2018, instituted for the offences under Sections 302 and 201/34 of the Indian Penal Code. Though the petitioner has been named in the F.I.R., but the accusation against him is only based on suspicion. Apart from the petitioner, other persons also have been made accused in this case. Some of such bail orders have been annexed with the bail petition. There is nothing else in the case diary, as it appears from the impugned order, beyond suspicion. Considering the nature of accusation which is purely based on suspicion of the informant, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Manjhaul, Begusarai in connection with Khodawandpur P.S. Case No. 121 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
