The petitioner apprehends his arrest in connection with Kalyanpur P.S. Case No. 235/2020 registered for the offences punishable under Sections 363/366(A)/34 of the Indian Penal Code and Section 8 of the POCSO Act.
It is submitted by learned counsel for the petitioner that the alleged victim was having an affair with Saddam and he has been taken into custody. The petitioner is brother of Saddam and he has no role in this case.
Considering the facts and circumstances, the present anticipatory bail application is allowed.
Accordingly, let the petitioner above named be released on bail, in the event of his arrest or surrender before the
Patna High Court CR. MISC. No.23562 of 2021(2) dt.21-12-2021 2/2 court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge VII cum Special Judge POCSO Act, East Champaran, Motihari, in connection with Kalyanpur P.S. Case No. 235/2020, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. Before releasing the petitioner on bail, trial Court is directed to verify the fact that Saddam is in custody. (Sandeep Kumar, J) Saif/- U T
