The petitioner seeks bail in Khusrupur P.S. Case No. 26 of 2017 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

53 litres of country made liquor is said to have been recovered from hump of straw located outside the house of the petitioner and the petitioner was apprehended. It is submitted by learned counsel for the petitioner that nothing incriminating article has been recovered from the conscious physical possession of the petitioner. He has no concern with the aforesaid hump of straw. He has no criminal antecedent. He has been languishing in custody since 22.05.2017.

No.28839 of 2017 (2) dt.03-07-2017 2/2 Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Court (Excise), Patna in connection with Khusrupur P.S. Case No. 26 of 2017.
