JUSTICE MADHURESH PRASAD ORAL ORDER 18-01-2018 Counsel for the petitioners and the State are present. The petitioners seek bail in a case registered for the offence under sections 302, 201/34 of the IPC. Counsel for the petitioners submits that the petitioners are brother-in-law and mother-in-law respectively of the victim. They have been made accused in this case for killing the step daughter of the informant. Similarly situated co-accused Banarsi Paswan has already been granted bail vide order dated 3.3.2015, passed in Cr Misc No. 7689 of 2015. There is no eye witness to the occurrence and the entire family members have been roped in this case on suspicion. Prior to the lodging of this case, they are not accused in other case. Petitioners are in custody since 15.10.2017 and 9.11.2017 respectively.

In the facts of the case, the bail application is allowed. Let

Patna High Court Cr.Misc. No.3188 of 2018 (2) dt.18-01-2018 2/2 both the petitioners as mentioned above be released on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Kumar Sudhanshu, Judicial Magistrate 1st class, Biraul, Darbhanga in Kusheshwar Asthan Police Station Case No. 144 of 2013 on the following conditions:- (a) One of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how they are related with them. The bailor will also undertake to inform the court if there is any change in the address of the petitioners.

(b) The petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
