The petitioner apprehends his arrest in Gaya Rail P.S. Case No. 136 of 2013 registered under Section 379 of the Indian Penal Code.

One Ram Murti reported that while he was travelling on Duranto Express and passing through Gaya Railway Station, his purse containing I. Card issued by the Govt. of Haryana, I. Card issued by MHA, Govt. of India, ATM Card (SBI), Railway MST, Samsung Mobile Phone No. 9810925922, cash Rs. 6,000/- & DMRC Metro Card was stolen.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The petitioner runs a mobile repairing shop. Somebody has kept the mobile with the SIM for its repairing in the shop of the petitioner, but the police recovered the

It appears that the mobile and the SIM both were recovered from the possession of the petitioner. Hence, I am not inclined to enlarge the petitioner on anticipatory bail in Gaya (Rail) G.R.P.S. Case No. 136 of 2013. Accordingly, the same is rejected.
