In this case, the petitioners are seeking anticipatory bail in connection with Buniyadganj P.S. Case No.93 of 2019, registered for the offence punishable under Sections 147, 149, 323, 307, 504, 427 and 379 of the Indian Penal Code. Allegation against the accused persons including the petitioners is to have surrounded and assaulted the victim causing injuries. During investigation, the police (in paragraph 21 of the case diary) has found the case true against the petitioners.

Looking to the entire facts and circumstances of the

Patna High Court CR. MISC. No.12353 of 2020(3) dt.03-09-2020 2/2 case, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected. However, if the petitioners surrender before the Court below within eight weeks from today and pray for regular bail, the Court below will consider the same and pass appropriate order preferably on the same day without being influenced by the order of this Court.
