JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 02.08.2017 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner happens to be husband of the deceased and his earlier prayer for bail was rejected by this court vide order dated 8.11.2016 passed in Cr. Misc. no. 37381/2016 giving liberty to the petitioner to renew his prayer for bail, if his trial is not concluded within six months. However, trial court has reported that first prosecution witness was produced in the month of April, 2017 and up till now, four prosecution witnesses could be examined and five prosecution witnesses are still to be examined. The aforesaid factual position of the case reflects that there is no possibility of conclusion of trial of the petitioner in near future.

Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge III, Siwan
