JUSTICE ARUN KUMAR ORAL ORDER 04-04-2018 Heard learned counsels for the petitioner and the State as well as learned counsel for the informant.
The petitioner, already in custody since 04.12.2017, seeks bail in connection with Majhaulia P.S.Case No. 290 of 2016 registered under Sections 302/34 of the Indian penal Code. Allegation in brief is that father of the informant was kidnapped by the FIR named both the accused persons and when he did not reached home, informant started searching him and found his dead body at a deserted place and suspected that both accused persons have killed his father.
Submission is that informant is not eye witness, only suspicion is raised by him and there is no other material against the petitioner and another co-accused similarly situated has been admitted to bail by a co-ordinate Bench of this Court vide order
Patna High Court Cr.Misc. No.19293 of 2018 (2) dt.04-04-2018 2/2 dated 10.11.2017 passed in Cr. Misc. No. 51995 of 2017. Learned counsel appearing on behalf of the informant opposes the prayer of bail.
Having considered the aforesaid facts and circumstances, the petitioner, namely, Naween Kumar Rai @ Naween Kumar is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran, in connection with Majhaulia P.S. Case No. 290 of 2016. (Arun Kumar, J) Sujit/- U
