The petitioner has been in custody since 03.11.2017 in connection with Bihra P.S. Case No. 221/2017 registered for the offences punishable under Section 363/366A/34 of the Indian Penal Code and Sections 8 of POCSO Act.

Learned counsel for the petitioner submits that the victim girl in her statement under Section 164 Cr. P.C. has not named the present petitioner and has stated that she herself had eloped with one Rakesh Kumar and have since married together and living peacefully. The parents of both the sides have accepted the marriage.

In view of such facts and circumstances, let the petitioner above named, be released on bail on furnishing bail
