The petitioner apprehends arrest in a case registered for the offence punishable under sections 420/120B of the Indian Penal Code and section 270(ii)/28/28A of the Drugs and Cosmetic Act.

Prosecution case is that in spite of availability of A+ blood in the blood bank, petitioner being lab technician, did not provide blood of the said group to the informant. Learned counsel for the petitioner submits that as a matter of fact blood was to be provided on the proper requisition from the Jai Prabha Blood Bank with recommendation of the doctor concerned and the informant was lacking the same. Similarly situated co-accused has already been allowed bail by

Patna High Court CR. MISC. No.13840 of 2022(2) dt.22-08-2022 2/2 a co-ordinate bench of this Court vide paragraph 14 of the bail petition. Petitioner has got no criminal antecedent. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate IV, Patna in Shastri Nagar Police Station Case No. 875 of 2018, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
