JUSTICE BIRENDRA KUMAR ORAL ORDER 03-07-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 30(a)/38/41 of the Bihar Prohibition and Excise Act, 2016.

From the house of co-accused Bindeshwar Rai huge quantity of foreign liquor was recovered and petitioner and others are said to be the business partner of Bindeshwar Rai. Submission of learned counsel for the petitioner is that the petitioner was not accused in any case registered prior to 05.02.2017. On the same day one more case was instituted against the petitioner vide Khusrupur P.S. Case No.21 of 2017. Considering the aforesaid fact, let petitioner,

Patna High Court Cr.Misc. No.28197 of 2017 (2) dt.03-07-2017 2/2 above named, be enlarged on bail on furnishing bail bond of Rs.20,000/-(Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Vaishali at Hajipur/Successor Court, in connection with Jurawanpur P.S. Case No.4 of 2017, with condition that petitioner shall file undertaking at the time of furnishing of the bail-bond before the Court-below that he would not indulge himself in such activity otherwise the Court below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
