====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-07-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Righa P.S. Case No. 253 of 2015, registered for the offence punishable under Sections 364/34 of the Indian Penal Code. The F.I.R. has been lodged against unknown person wherein it has been alleged that a mobile call was coming since 20 days on the mobile of the informant and he was asked to work in a Film and thereafter when he reached Riga Railway Station, he was kidnapped by unknown criminals. It appears that the victim himself is the informant and has filed the F.I.R. The learned counsel for the petitioner submits that the name of the petitioner came in the confessional statement of coaccused Ramjee Rai. It is further submitted that the said Ramjee

Patna High Court Cr.Misc. No.30436 of 2017 (2) dt.06-07-2017 2/2 Rai has already been granted regular bail on 30.05.2016 in Cr. Misc. No. 23963 if 2016 and another co-accused has already been granted bail on 25.05.2017 passed in Cr. Misc. No. 19122 of 2017 by this Court. It has been further submitted that in another matter in which the petitioner has been remanded i.e. Mejarganj P.S. Case No. 169 of 2015, he has been granted bail by this Court on 27.07.2016 passed in Cr. Misc.No.29671 of 2016. Having regard to the facts and circumstances of the case more particularly considering the parity of the case of the petitioner with that of co-accused, who has been granted bail by this Court, I deem it fit and proper to enlarge the petitioner on regular bail.

According, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned C.J.M., Sitamarhi in connection with Riga P.S. Case No. 253 of 2015.
