The petitioner seeks bail in a case registered under Section-302/34 of the Indian Penal Code.

Allegedly, the accused persons came at the house of the informant and opened fire which hit the informant's maternal uncle. The informant's maternal uncle sustained bullet injury and was taken to hospital where in course of treatment, he died.

It has been submitted that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 07-12-2022. The petitioner has remained in custody for about five months. Charge sheet has already been submitted in this case. The trial is not likely to be

Patna High Court CR. MISC. No.15115 of 2023(2) dt.01-05-2023 2/2 concluded in near future. The petitioner is alleged to be an order giver. No specific overt act is alleged against the petitioner. No injury is alleged to have been caused by the petitioner upon the deceased.

On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Court below/concerned Court in connection with Sikandra P.S. Case No. 24 of 2020.
